Terms of Service

Last updated: 2026-07-29

Section 1 — Scope

These Terms of Service (hereinafter "Terms") govern the use of the Say Yes platform (available at sayyes.love) and related mobile applications, operated by Dr. Sven-Eric Molzahn — Molzahn Software, Lommelstrasse 1, 85101 Lenting, Germany (hereinafter "Provider").

Say Yes is a digital wedding management service that enables couples to plan their wedding, manage guest lists, track RSVPs, and use other wedding-related features.

Deviating terms of the user shall not become part of the contract unless the Provider expressly agrees to their applicability in writing.

Section 2 — Formation of Contract

The presentation of services on the website does not constitute a legally binding offer but an invitation to submit an offer (invitatio ad offerendum).

By registering a user account, the user submits a binding offer to enter into a usage contract. The contract is formed upon confirmation of the registration by the Provider (account activation).

For paid tiers (Premium, Premium Plus), the extended contract is formed upon successful payment processing via the payment service provider Stripe.

Section 3 — Service Description

The Provider makes available to the user a web-based and mobile platform for wedding planning. The scope of services depends on the selected tier:

  • Free tier: Up to 50 guests, up to 3 events, basic RSVP management, event schedule sharing, wedding details page.
  • Premium (one-time purchase): Unlimited guests, events and info pages, announcements to all guests, RSVP reminders, data export (CSV), and custom RSVP questions.
  • Premium Plus (one-time purchase): All Premium features plus photo gallery with a public QR link, live slideshow, photo tasks, original-quality storage, albums, reactions and comments, video uploads, digital guestbook (text, audio, video), and multiple administrators.

The Provider reserves the right to further develop and improve the scope of features of each tier. Significant restrictions to existing features will be communicated to affected users with reasonable advance notice.

Section 4 — Prices and Payment

Use of the Free tier is free of charge. The Premium and Premium Plus tiers require one-time purchase prices. The current prices are available on the pricing page of the website and are stated in Euros, inclusive of applicable statutory VAT.

Payment is processed through the payment service provider Stripe Inc. The purchase price is due once upon contract formation. This is not a subscription; no recurring fees apply.

In the event of an upgrade from Premium to Premium Plus, only the difference between the two tiers is charged.

Section 5 — Right of Withdrawal

Consumers have a statutory right of withdrawal.

The complete cancellation policy and sample cancellation form can be found on our separate page: Cancellation Policy.

Section 6 — User Rights and Obligations

When using the platform, the user undertakes in particular:

  • not to upload or distribute any unlawful, offensive, discriminatory or otherwise objectionable content;
  • not to use the platform for automated access (scraping, crawling) or other purposes not intended by its design;
  • to keep login credentials confidential and to protect them from unauthorized third-party access;
  • to inform the Provider without delay if there are indications of unauthorized use of the account;
  • to comply with all applicable laws, in particular regarding the data protection of invited guests.

Section 7 — Availability

The Provider endeavors to ensure uninterrupted availability of the platform. However, 100% availability cannot be technically guaranteed. In particular, maintenance, security, or capacity work, as well as events beyond the Provider's control (e.g. disruptions to public communication networks, power failures, force majeure), may lead to temporary restrictions.

Planned maintenance work will be announced in advance where possible.

Section 8 — Limitation of Liability

The Provider is liable without limitation for damages arising from intentional or grossly negligent breach of duty by the Provider, its legal representatives or vicarious agents, as well as for damages resulting from injury to life, body, or health.

In the event of a breach of material contractual obligations (cardinal obligations), the fulfillment of which is essential for the proper performance of the contract and on which the user may regularly rely, the Provider's liability for slight negligence is limited to the typical, foreseeable damage.

Otherwise, the Provider's liability for slight negligence is excluded. The above limitations of liability also apply in favor of the Provider's legal representatives and vicarious agents. Liability under the German Product Liability Act remains unaffected.

Section 9 — Data Protection

Information on the collection, processing, and use of personal data can be found in our Privacy Policy.

Section 10 — Termination

The user may delete their account at any time. Deletion terminates the usage contract. Payments already made for one-time purchases will not be refunded upon termination by the user, provided that no right of withdrawal exists.

The Provider may terminate the usage contract for good cause without notice, in particular if the user violates these Terms, posts unlawful content, or misuses the platform.

In the event of justified termination by the Provider, there is no entitlement to a refund of payments already made.

Section 11 — Changes to the Terms

The Provider reserves the right to amend these Terms with effect for the future. The user will be informed of changes at least 30 days before they take effect by email.

If the user does not object to the amended Terms within 30 days of receipt of the notification, the amended Terms shall be deemed accepted. The user will be separately informed of this right to object and the consequences of failing to object in the notification.

Section 12 — Final Provisions

The laws of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only insofar as it does not deprive the consumer of the protection afforded by mandatory provisions of the law of the state in which the consumer has their habitual residence.

Should individual provisions of these Terms be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.

The place of jurisdiction for all disputes arising from or in connection with these Terms shall be, to the extent legally permissible, the Provider's registered office.
